Clerk gets awarded HK$140,000 for a day’s work

An account clerk was awarded HK$140,000 in compensation, after she tripped and fell, breaking her wrist on the first day of work.

The applicant then took 487 days of sick leave and medical reports indicated that she had lost 3% her earning power permanently as a result of the injury.

The accident took place in February 2013.

The respondent FKD Express Co. Limited claimed that they are not responsible for the applicant, Ting Wa’s compensation because she was not an employee of the company.

FKD told the court that Ting was taking her job interview on the day and has no intention to hire her because she doesn’t know how to operate the computer.

But Ting was able to convince deputy district judge Liu Man Kin that she was under-employment at FKD by presenting to court with a staff card and a 100 dollar red-packet which was given by the employer on the first day of work after the Chinese New Year break.

Ting told the court that she went out with a colleague for lunch and then picked up some documents.

On the way back to the office, she tripped over some stones and fell.
